Miller had been thumbing through the amended subdivision ordinance and announced that the rezoning would have to take place before final plat approval. “The time limit doesn’t seem to be a problem,” he said, adding that the old ordinance deemed &ny subdivision approved if no action was taken before a 60-day time limit, beginning with preliminary plat application, expired.

Wesley Harris interjected that the stipulation referred to by Miller was still in the ordinance. He read from page 13 of the amended ordinance that if no action is taken within 60 days, the subdivision is deemed approved.

Luke maintained that the time limit had not begun because the application was not complete without an erosion and sedimentation control plan.

Miller wasn’t as positive that time didn’t begin when the preliminary plat was submitted and suggested that the Commission obtain a legal opinion.
