According to the minutes of the special meeting, Davis warned that a court may consider the distinction between the uses permitted by right and the uses allowed with a special use permit in a business-commercial zone as “unreasonable.” He further stated that “to zone the ski area General Business or Commercial and yet deny the Rappahannock Ski Corporation the Special Use Permit for uses compatible with the purposes for which it was zoned and which it needs to make a profit is like saying someone can use a car but will not be allowed to put gas in it or someone can operate a farm but will not be allowed to grow crops on it.”
