The issue before the board hangs on whether extending the commercial zone 0.26 acre to include the old mill building will increase the chances of the property being put to an objectionable use, Luke said.

"I think it’s a fairly different case from the rezoning (request from Dorothy Davis) considered earlier,” stated Supervisor Dick Latham.

“We have the flexibility to consider (rezoning applications) on a case-by-case basis,” Luke noted.

“We can’t tear down the mill and rebuild it with something else (if the rezoning is approved),” interjected Kramer. “It’s within 50 feet of flood plain,” he said, adding that using the mill for a purpose allowed by right in a commercial district was his only option if the rezoning request was approved.

If the mill falls down, Konick maintained, there is a greater chance that an owner of the three acre tract will use the upper portion of the property with its existing commercial zoning for an objectionable purpose. If the
