rental dwelling could be built on the three acres. Miller said he knew of no restrictions that would prevent such action, as long as the parcel wasn't subdivided. Despite the language in the comprehensive plan, Miller continued, the intent of the supervisors and planning commissioners was to direct commercial development around existing villages and to the area along Route 211 between the town of Washington and Rappahannock County High School. Approval of Brown's rezoning could set a precedent, however, for strip development on Routes 211 and 522 from one end of the county to the other. Miller said. "If every piece of property less than five acres along Route 22 can be rezoned, we have no protection for agricultural land," Fannon said. “Then what purpose is a zoning ordinance?" he asked in response to Brown's contention that the three acre tract shouldn't qualify as agricultural since there was “no land there to farm."

Since adoption of the county’s zoning ordinance, the only property rezoned commercial in the Amissville area has been Elmer Jenkins' garage. Miller noted.

A. Y. Stokes added that approval was granted Jenkins on the grounds of hardship after the highway department acquired the original site of his business through condemnation for expansion of Route 211.

“1 don’t want to create a situation where anyone wanting to rezone property along the highway could get it," Donald Brown responded. He told the commissioners that he "woulnd’t feel bad" if they denied his rezoning application. "That's the way it is."

“If that's the way it is, I want it to stay that way," his father agreed. The elder Brown, however, went on to describe the situation in Rappahannock County as regards an individual's personal property rights as
