Rezoning
(Continued from Page 1) commercial zoning and nothing else,” Clater repeated.
Once the property is zoned commercial, the landowner is entitled to all uses allowed by right in that category and can apply to the Board of Zoning Appeals for other uses permitted with a special use permit, commissioner Werner Krebser noted. He added that the garage, a use that the property was put to when the ordinance was adopted in 1973, would be allowed to continue under the "grandfather” clause.
Acknowledging that Payne’s property was intended to be zoned commercial when the county’s ordinances were adopted in 1973, Krebser said he still had a problem in approving the rezoning application without also addressing the issue of what should be done about the two parcels which were zoned commercial by mistake in place of Payne’s lot.
“What is going to happen to those other two parcels?" he asked, pointing out that Rappahannock's comprehensive plan specifies that commercial zoning should be kept off Route 211 except in the Flat Woods area between Washington and Sperryville.
By majority vote with Krebser opposed, the commissioners recommended that the board of supervisors approve Payne’s rezoning application. "The time to handle the rest of the issue is in the revision of the new ordinance." Miller noted. The commissioners set a work session on the proposed ordinance revisions for June 30 at 8 p.m. in the courthouse.
They also scheduled a public hearing for revisions to the county’s erosion and sedimentation control ordinance for July 21 at 7:30
