location as required by said statute is that obtained by using the most recent "Tide Tables" and adjustments thereto published by the National Ocean Survey, National Oceanic and Atmospheric Administration of the United States Department of Commerce. Any person requesting the Commission to use an alternative method of calculating such depth, at a given location, shall bear the burden and expense of establishing to the satisfaction of the Commission, that such depth is in fact other than that obtained as described therein.
CHAPTER 28. Watercraft.
R28-1. (b) Notwithstanding any contrary or inconsistent provision of the Code of Federal Regulations now or hereinafter adopted pursuant to subsection (a) of this regulation, the term "recreational boat" as used in these regulations shall mean any motorboat or vessel maufactured, used, leased, rented or chartered primarily for non commercial use.

R28 2. Occupied motorboats drifting or at anchor between sunset and sunrise shall exhibit at least one white light that can be seen all around the horizon for a distance of at least one mile. This provision shall not be applicable in areas where boats are regularly moored or in sheltered coves not normally used by motorboats under power for through passage.
