Kirk Michael Keller’s driving while intoxicated conviction was overturned in Rappahannock Circuit Court by Judge William Shore Robertson on Thursday, July 18. Keller based his appeal on an argument that his breathalizer test result should not have been put into evidence since he had requested a blood alcohol test.
Keller was convicted of DWI in Rappahannock General District Court in the spring. The DWI law in effect at that time required a law enforcement officer to read the implied consent law to anyone stopped for driving under the influence of alcohol. The implied
