During questioning by Casey, Jenkins testified that the investigators never told him he must confess to be released.
Jenkins said the investigators never said he was required to stay or continue answering questions. He also said he was never threatened by the officers.
Jenkins made an allegation against one of the officers who was questioning him when he confessed.
According to the motion to suppress the evidence, investigator Gar> Healy suggested leniency to Jenkins it he confessed to the sexual molestation charges, by telling Jenkins, " 1 he Commonwealth’s attorney is a guy. he’ll-understand ”
Healy emphatically denied this allegation. Healy said when he and his colleague, investigator Joe Hughes, questioned Jenkins, "all we were looking for was the truth.’ ... Casey argued in court that Jenkins signed a form that waived his right to remain silent before confessing l*e said Healy did this even though he was not required to inform Jenkins of his rights because he was not under arrest.
