A BUYER'S AGENT One of the more confusing principles in real estate is agency - a body of law governing representation between principals and agents. Technically, because the seller pays the commission to the selling agent, that agent has a responsibility to the seller. Although a great many buyers assume that the agent with whom they are working is their agent, he or she must, by law, w'ork on behalf of the seller. Fortunately, for everyone involved, the law concerning agency is changing throughout the country. In many state, laws promoting buyer agency have been passed. These laws allow a buyer to hire his own agent to work exclusively for him. The buyer is obligated to work with that agent and no one else. That agent is obligated to exclusively represent that buyer's best interest. In this arrangement, the agent is either paid by the buyer or by the seller provided the seller consents to working with a buyer's agent.
