In execution of a Deed of Trust dated 22 March, 2002 and of record at Instrument #020000598 in the land records of the Office of the Circuit Court of Rappahannock County, Virginia, securing a promissory note in the amount of $151,231.40, default having been made, the undersigned, David L. Konick, Substitute Trustee, will offer for sale at public auction at the entrance to the Rappahannock County Circuit Courthouse at 238 Gay Street, Washington, VA 22747 on 24th day of JUNE, 2004 at 2:00 P.M. the following improved parcel of land located at 604 Zachary Taylor Highway, Flint Hill, Rappahannock County, Virginia and more particularly described as follows:

All that certain tract or parcel of land with improvements thereon, lying and being situate in Wakefield Magisterial District of Rappahannock County, Virginia, being described as Lots 28 and 29 in the Town of Flint Hill, and bounded and described in a certain Deed from Susie Millan to George P. Browning, dated February 6, 1919, and recorded in the Clerk's Office of the Circuit Court Rappahannock County, Virginia in Deed Book 29 at Page 170 as follows: House and lot situated in the Town of Flint Hill, Virginia on the east side of Main Street of said town and adjoining the lots of Ms. S. J. Millan, Mrs. Sallie Oden and Mr. J. E. Ricketts: AND BEING the same property conveyed to Phyllis Pricer, unmarried, and Catherine W. Criscione, widowed and unmarried, by Deed dated May 23, 1994, of record in the aforesaid Clerk's Office in Deed book 206 page 305. The said Catherine W. Criscione died May 30, 1999 and reference is hereby made to her last Will and Testament filed for record in the aforesaid Clerk’s Office in Will File No. CWP 0215 for further derivation of title. Tax Map No.: .13 125.

TERMS OF SALE: A deposit of $5,000.00 or 10% of the successful bid, whichever is less, in certified funds payable to David L. Konick, Substitute Trustee will be required from the highest bidder before the bid is accepted. The balance of the successful bid shall be paid in certified funds at settlement within thirty (30) days from the date of sale, provided that the Trustee may extend the date for settlement for good cause. Purchaser’s failure to proceed with settlement within 30 days or on such date as agreed by the Trustee shall be deemed a default by the Purchaser and shall result in the forfeiture of the deposit to the Trustee in payment of fees and costs. Conveyance of title will be by Trustee's Special Warranty Deed. The property will be sold AS IS with no representation or warranty as to the physical condition of the property or its improvements. The fee and costs of the Trustee, Grantor’s Tax, delinquent and pro rata real estate taxes shall be paid from the sale proceeds. All other costs and recording fees shall be paid by the Purchaser.
