The new Article XVII will create the Rappahannock County Conservation Easement Service District This District will cover the entire County. The purpose of the District is to raise revenue through the annual levy of taxes on real and personal property within the District, which revenue shall be used exclusively for one or more of the purposes allowed by the OpenSpace Land Act, §10.1-1700 et seq, of the Code of Virginia, and to acquire within the District "open-space land" and "open-space easements" as those terms are defined by §10.1-1700 of the Code of Virginia. Such acquisitions may be made when, in the opinion of the feoard of Supervisors, they are in accord with the Comprehensive Plan and will help the County in: (1) retaining or protecting natural or open-space values of real property and assuring its availability for agricultural, forestal, recreational, or open-space use; (2) protecting natural resources; (3) maintaining or enhancing air or water quality; preserving the historical, architectural or archaeological aspects of real property; § (4) providing public parks or recreational uses and facilities; (5) conserving land or other natural resources for historic or scenic purposes; and, (6) the shaping of the character, direction, and timing of development to ameliorate the impact on the County. No/property may be acquired under the new ordinance by condemnation. Land will be taxed at its land-use value, and all exemptions and tax-relief provisions applicable to real estate taxes shall likewise apply to taxes assessed under the new ordinance.
