Juage wmsenant denied the motion for contempt citing the scant time allowing Gordon to cooperate - the time between the award of the injunction and the filing of a contempt of court motion. The judge said to Downey, “Your witness doesn’t kiiow why the system went down.”
Gordon did not show up in time for the injunction hearing last Friday, and he did not have an attorney at the time. His lawyer said he intends to file a motion to have the injunction dismissed.
“You cannot enjoin someone to make them work for nothing,” said Fallon referring to the cooperation demanded by the order.
Shoemaker said he hoped service would be restored by yesterday, but as of this writing, the system was still only partially up.
He also commented that with Gordon’s attorney present, they were able to get “a lot more information last night from Mr. Gordon.
