Complaints being received by the Virginia Department of Agriculture indicate that some of the paints being offered by fut-of-state manufacturers on
exclusive franchise do not comply with the Virginia Paint Law. The franchises are offered through newspaper advertisements, magazines and personal contact. The dealer is required Jo buy a minimum amount of paint. In some cases, many thousands of dollars cash is required to buy a minimum amount of paint. “Do not sign any contract if you are not fully satisfied you are dealing with a reputable person or company," warns Richard C. Bricker, director of the paint law and laboratory of the department’s division of technical services. “These operators never approach established paint dealers who know the Virginia Paint Law. Opr experiences in some of these cases show that the paint may be good, but the label and advertising material bear misleading claims and outlandish guarantees. The paint may be satisfactory for certain uses, but it is sold to the dealer at a wholesale price much higher than the retail price of comparable or better paints." Bricker advises, "Never buy paint from an unknown person or company until you have proof that the paint is registered and conforms to requirements of the Virginia Paint Law." if there is any doubt, he requests that VDA’s paint section be contacted.
