In * tetter to George H. Davis, Commonwealth Attorney, the Commission pointed that under the utility facilities act passed by the General Assembly of Virginia in 1950 the state was divided up into territories within which only one utility of a kind could lawfully operate to “sell electricity.” According to the Commission a company can generate, transmit and sell electricity in its own territory without further authority from the Commission. If a company wants to sell electricity to the public in new territory it has to apply for a certificate “after formal hearing upon such notice to the public as the Commission may prescribe.” But if it wants to acquire utility facilities outside its territory the Commission can issue certificates for such after “formal or informal hearings and after due notice to interested
