If it was a legal business when the ordinance was enacted then it is conforming and can be rebuilt, according to Newbill Miller, adding that there is nothing “non-conforming” in a business-residential district like Sperryville.

“But how about someone like Colonel Luke?” asked Helen Kilby. “His land would be too steep.”

“And it also doesn’t have enough acres,” Luke said, pointing out that his property could be considered non-confirming for two reasons.

“If it was a recorded lot at the time this ordinance was passed it is now considered conforming, Miller maintained.

“BUT THEN why is there any point in having something non-conforming if they can build it back again?” Mrsr^Kilby asked.

Miller explained that the only non-conforming structures are actually new > ones. A pre-existing structure may be considered non-conforming because it does not conform to the use designated for the area in the ordinance. But the restrictions for use, based on the ordinance, will only be enforced when a permission to construct a new building is sought. Those already there can legally remain, safe under a “grandfather clause,” he thought.
