No Money For Legal Counsel
BZA members also authorized a letter to the Board of Supervisors, informing the Supervisors of possible impending legal action and advising them of the BZA’s intent “to procure the services of a lawyer with imminent qualifications in the field of zoning law.”
McNear noted that the BZA had no money for legal counsel and said fees would have to be paid out of the county’s general fund.
Attorney Maurice Biddle, representing the owners of property adjoining DeMent's who had previously filed suit against both DeMent and the BZA, said his clients had decided to continue their case to await the results of BZA action.
