An examination of records in the Rappahannock Zoning Administrators office indicate that Steve DeMent has complied with stipulations listed in his building permit for the construction of his new building in Sperryville. DeMent’s special use permit issued for the building was first suspended by the Board of Zoning Appeals in June and at the BZA’s July meeting, the permit was revoked. The BZA members have indicated that their action is based on DeMent’s non-compliance with provisions attached to his special use permit—specifically, a setback requirement that stipulates the new structure must be 50 feet from the adjoining property line and a requirement that the new structure be an extension of the existing facility.

The building constructed by DeMent is located 50 feet from Route 522 but considerably less than that distance from the Stuckey s adjoining property. It is also an independent structure, joined to the existing facility by a “breezeway.”

While the special use permit issued to DeMent on April 14 stipulates that the 70 foot by 40 foot garage and storage area addition must extend from the existing building, it does not specifically address setback requirements. Indirectly, the matter of setback requirement may be covered.
