As the record shows no further pertinent communication between the Supervisors and the Planners, the questions of whether the Supervisors set a time limit for the Planners’ response to the ordinance amendments depends on the interpretation of Luke's August 3 letter to Barksdale.
The issue of the 90 day period allowed the Planners is pertinent to a suit brought .against the Supervisors by the Rappahannock Chapter of the Izaak Walton League. The suit filed November 29 seeks to overturn the ski area amendments.
It argues, in part, that the Supervisors’ failure to follow the procedure set forth in the Code of Virginia allowing the Planners up to 90 days to make recommendations contravenes a mandatory requirement, violates due process and renders the
