Ordinance An Encroachment
“Let’s face it. The zoning ordinance is really an encroachment on the building," stated Luke. He cited several buildings in Sperryville-the old Co-op., Fairlawn Antiques and Jimmie Swindler’s gift shop—that lie in flood plain.
“We’re trying to make a mountain out of a mole hill on this,” he maintained. Luke noted that Rappahannock used soil types to designate flood plain areas while other parts of the country used 100-year high water mark. Luke added that federal law allows building in a flood plain if the structures are flood proof.
No one on the Planning Commission is an expert on flood plain construction, he continued. The experts—County Engineer Fanning Baumgardner and Soil Conservationist Bill Adams—“are not rolling over and saying that this is the most horrible thing that ever happened,” Luke said.
