Legal action brought against P. E. Steve DeMent by Col. Evan McNear in his position as Zoning Administrator for Rappahannock County has been dropped. The case, in which DeMent was charged with failure to obtain a building permit for a structure costing $500 or more, was scheduled to be heard in District Court this Friday.
“We consulted with our counsel and they strongly advised we go on another course,” McNear said on Tuesday. According to legal advice, “Virginia statutes support a civil action much, much better” than a criminal action, McNear said, "There’s no question but that it will be pursued” with a civil suit filed at a later date, he added.
