19 following expiration of a June 15 deadline set by the Board of Zoning Appeals. The BZA had given DeMent until that time to modify new construction to his Sperryville antique business so that the building complied with its « special use permit.
DeMent’s building permit was revoked by the BZA in June, 1977, after he allegedly failed to follow stipulations in the accompanying special use permit. Th^ revocation was subsequently upheld by Circuit Court Judge Rayner V. Snead in August, 14/8. in a letter dated May 15, 1979, the BZA notified DeMent ' that the addition to his antique building was an “unlawful structure” and must therefore be modified to meet requirements set forth in the original special use permit.
