The trustees, however, failed to repeat the vote taken on the two candidates. Virginia’s Freedom of Information Act requires that all votes cast in executive or closed sessions must be repeated publicly in order to be valid.

According to legal sources, the trustees can bring their earlier actions into compliance with state law merely by meeting again and voting in open session to fill the two school board vacancies.

In his opinion, Coleman also held that participation of electoral trustee Granville Eastham in the selection of his brother, Robert Eastham, as a school hoard member did not constitute a conflict of interest under state statutes.
