During the 60-day period, the supervisors must hold a public hearing and render a 1 decision. If they decide to prohibit the taking of land from the district, the highway department may appeal to the local circuit court. This change in rules makes expenditures by any nonlocal public agency, a local governing body or a public service corporation for the purpose of providing services for non-farm uses subject to public scrutiny. By evaluating alternatives to any proposed action within an ag district, the supervisors can ertsure that ONLY the proposed action, and not any alternative that wouldn't impact the ag district, provides the services in the most economical and practical manner.

As this relates to the Sperryville by-pass, the highway department would have to show that a by-pass through an ag district is the most economical and practical approach to improving Route 211.
