I he by-pass and plans tor double laning Route 211 through the town were discussed at public hearings several years ago. No decision was reached by the highway department at that time and currently, Johnson has an application before the planners for formation of an agricultural and forestal district on his property.
Estes’ claim that approval of the district will block any possibility of a Sperryville bypass met with almost a minute of silence from the rest of the planning commission. “Umph,” grunted several planners in unison. “That sure is a can of worms," planner Alan Stokes remarked.
By-Pass Still Possible
Actually, approval of Johnson’s ag district application WILL NOT automatically prevent the highway department from acquiring the necessary land for construction of a Sperryville by-pass.
The agricultural and forestal districts act restrains but does not prohibit powers of eminent domain. Rather, it sets new procedures for the exercise of that power which apply if more than 100 acres are to be taken from the district.
