Concern For Father

Asked by the commonwealth attorney why he didn’t just tell the deputies where his father was, Atkins answered that he was "concerned about what was going on” and wanted to be there when the deputies went to talk to the 67-year-old Levi Atkins .Sr. He added that deputy Crossman had appeared to be quite satisifed to wait until he finished his supper.

In his summation, Fletcher argued that, without a search warrant, the deputies should have either waited for Atkins to finish eating and take them to his father or gone to find Levi Atkins Sr. on'theiF own. He described Atkins and his wife as long-time residents of the county and credible witnesses, noting that the two deputies have lived in Rappahannock less than two years.
