September 23 and 24. Proceedings have been delayed repeatedly over the past two years, first for three separate mental examinations to determine Douglas' competency to stand trial. The case finally was scheduled to go forward last year but charges were nol prossed when Marx, the chief complaining witness, refused to appear in court.
Then commonwealth's attorney Douglas Baumgardner brought the case back before the grand jury in August for a new indictment after Douglas, a resident of the Richmond area, returned to the county and moved into Marx’s home near Washington. (Marx now resides in Northern Virginia.)
Although Douglas has insisted on representing himself in court, he has agreed to consult with an attorney in the current round of legal proceedings.
