In addition to allowing him time to get the documents which Douglas maintains will prove that Peter Marx is John D. Marx, Payne said, a continuance will give his client time to subpoena witnesses he feels are critical to his case: his former psychiatrist, his former wife, his former sister-in-law and former U.S. President Jimmy Carter. Payne noted that Douglas doesn’t have addressses for either the wife or sister-in-law.
In arguing against the continuance, commonwealth’s attorney Douglas Baumgardner maintained that the items sought by Douglas are unreasonable and irrelevant to the charges of malicious wounding.
Further, in relation to Douglas’ plan to use documents from earlier legal proceedings to attack Marx’s credibility, Baumgardner noted that a witness can’t be impeached on collateral matters that are far outside the scope of the current charges against Douglas.
If a continuance is granted. Baumgardner warned that he will ask for Douglas' recommitment to a state institution for further competency examinations.
‘‘He’s already had me examined so many times. I'm getting tired of it,’’ Douglas complained, "The commonwealth's attorney has already held up this trial for two years.”
