Called as the first witness for the commonwealth, Peter Marx said the defendant had arrived at his family's weekend cabin near Washington the day prior to the shooting but indicated he was returning to his home in Richmond. Marx testified that he was surprised, therefore, to see Douglas's car in the road in front of his property on the following day, November 18. He said he was looking in the car window when the defendant walked up. Upon request, Marx said, Douglas left but returned a half hour later, stopped his car and took a rifle from the trunk.
