Recalling Peter Marx to the stand. Dudley Payne read testimony from U.S. District court records in which Marx admitted entering John D. Marks' house with Douglas, writing a falsified perscription for the drug preludin for the defendant and then taking the drug with him. Confronted with the inconsistency in his testimony, Marx maintained that he didn’t recall making the statements in the 1977 District Court case but if the record showed he had admitted entering the house and writing the perscription, "that must be the case." In his summation to the jury. Baumgardner asked if Douglas would have left Marx in the back of a pickup truck, bleeding profusely, if he had in fact been making a citizen’s arrest. He told the jury they could infer that Douglas acted with malice through 'his use of a deadly weapon and reminded the six men and six women that an eye witness to the shooting testified Douglas had threatened to kill Marx. He also noted that the defendant admitted to U.S. attorney Carpenter that he’d kill Marx if he got another chance.

Douglas shot Marx because he hated him and wanted to kill him, not because he was trying to make a citizen’s arrest, Baumgardner said.

In his final arguments. Douglas claimed he was the victim, not Marx. He said he’d tried to have Marx arrested and failed and so “shot him to teach him a lesson.” he noted that he could have killed Marx but only wounded him because "I wanted this man here” in court.

In a last word, he told the jury that if he had to go back to jail for one more day. he wanted them to give him the entire 20 years, the maximum sentence for malicious
