Roger Yowell, who was cutting lumber in the vicinity during the time of the shooting, testified that he had seen Douglas up on the mountain twice previously with Marx but on neither occasion had he heard Marx say he didift want the defendant on his property. Instead, said Yowell, Marx appeared to be showing Douglas around the place.
