The issuance of the variance and permit was challenged in a suit brought against the BZA in October, which alleged that the board had violated provisions of the county's zoning ordinances and acted in bad faith.
Following an executive session held in November. BZA members Peter Kramer, lames Swindler and chairman Josef Gardiner voted to authorize commonwealth's and county attorney Douglas Baumgardner to seek the reversal.
