Returning again to the charge of perjury, Douglas asked whether Carpenter would prosecute if he could prove Marx's disposition to in federal court was false.
Whether to prosecute or not was a decision that would have to be made under U. S. attorney office guidelines on prosecution and with the approval of the senior U. S. district attorney, according to Carpenter.
Under questioning from the defendant. Carpenter testified further that he did not contact the Chesterfield County police, warning them about Douglas' intention to visit the Obenshein residence; that he had nothing to do with any alleged police plan to plant drugs on Douglas and that he did not recall a conversation between himself, Douglas and a secret service agent in which Douglas claimed Carpenter acknowledged that a handwriting expert had found the handwriting of Peter Marx and John D. Marks to come from the same person.
