Marx said he suffered*^ other health complications as a result of the shooting, including a heart condition. Under questioning from the commonwealth's attorney, Marx said he had never threatened Douglas with bodily harm and characterized the conspiracy charges to overthrow the ynvgfjmen[ at_laJjSOlUJteJv absurd.”
Marx said he called for help and asked for an ambulance after the shooting but got no response. He said Douglas walked to the back of the truck where he was lying, pointed the rifle at him and asked if he wanted a slug in the head or in the heart. He next opened the trunk "and said something about me getting in the trunk of his car," Marx testified. Then, said Marx. Douglas abruptly left.
