Under law. perjury requires a false statement under oath that is relevant to the issue at hand. Carpenter explained, adding _,that whether John Peter Marx was John D. Marks or not was not relevant to the issue involved in the civil suit.
The U. S. attorney denied threatening to have Douglas committed. "1 said I thought you should voluntarily commit yourself." he told the defendant. Carpenter acknowledged also that he'd told Douglas he must have a psychiatric examination before his office would pursue charges further.
"Why?" Douglas demanded.
"Because I didn't believe you, Mr. Douglas." Carpenter replied. After he’d learned of the shooting incident in Rappahannock, the attorney said, he'd told Douglas to communicate by either telephone or letter and not to return to his office or face arrest for trespassing.
