“He has stated that the structure is perilous to passers-by,” noted the judge in lifting the restraining order. “If he proceeds to build, he’ll do it at his own peril...If the court finds the BZA’s action was improper, he may be out of pocket whatever he put on the site.”
In other cases heard Monday, John A. Williams pleaded guilty to an amended charge of petty larceny. Last June, Williams wrote over $1,200 in bad checks drawn on the Rappahannock National Bank, according to stipulations at Monday’s hearing. Restitution has now been made for all but $61 of that amount, commonwealth’s attorney Douglas Baumgardner noted.
On the guilty plea to the amended misdemeanor charge, Williams’ first offense, Judge Robertson sentenced the man in accord with terms of the plea agreement to 12 months in jail and a $250 fine plus court costs and payment of the remaining $61. The judge suspended both the jail term and the fine and placed Williams on two years unsupervised probation.
