A five-member Rappahannock Grand Jury returned indictments Monday against Robert Lee Rainer, 39, of Huntly, and James Robert Smoot, 40, of Flint Hill, for a string of crimes committed before Christmas in the Flint Hill area.
The two men face five felohy and two misdemeanor charges for the theft of evergreen trees from Ralph Woodruffs Yule Log Christmas Tree Farm, the theft of an arborvitae tree from Franklin Hume, breaking and entering and theft of canned stuffs and a chain saw from Foster Brothers Packing Shed, and the malicious killing of a black and white cow belonging to Cory Korel of Jordan River Farm and the theft of that same beef.
Judge Shore Robertson set personal recognizance bonds of $1,000 for eaach man and continued the companion cases until Jan. 27. The judge also named Madison lawyer Roy Bradley as the court-appointed attorney for Mr. Smoot and confirmed the appointment of Lee Albrecht of Warrenton as Mr. Ramey’s attorney.
Charges against the two were not prosecuted in General District Court last week. Commonwealth’s Attorney Peter Luke explained that he opted to bring the charges directly to the Grand Jury in order to eliminate one court appearance. Seeking a direct indictment instead of proceeding through a preliminary hearing in General District Court • means “less inconvenience to the victims and witnesses,” Mr. Luke noted.
