Mr. Freeman next called Alan Davis, who has been a friend of the defendant’s for 10 years, and also knows the victim and her boyfriend. He claimed that when he stopped by the trader to see the victim’s boyfriend on Oct. 19, the victim did not appear upset.
Mr. Freeman called several character witnesses for the defendant, including friends and employers of Mr. Taylor. They testified that Tommy Taylor’s reputation in the community was one of non-violence, peace, good order and truthfulness, but none could prove that they had seen the defendant between 9 a.m. and 9:30 a.m. Several had seen him after 9:30 a.m.
Taylor then took the stand in his own defense. He claimed that he had gotten up at 9 or 9:30 a.m. on Oct. 19. He said, “I went to the store to get a cup of coffee. There was a knock on the door around 9:30. Harlan Coffey was at the door. He wanted me to ride and look at Todd and Sandy’s property. I told him I had to help my father. I got more coffee at the store. Then I went to check on my father’s cows, probably about 9:45 a.m. Then I went home. At 10:30 or 11 a.m. we went to get the doghouse.”
He further stated that he did not have on camouflage that day, and that the last time he had been to the trader was a month or six weeks prior to Oct. 19. He said, “I was not ’ in the trailer on that day.”
Mr. Luke asked the defendant, “Did you ever ask her to put a bathing suit on?”
The defendant answered “No.”v He also stated that he had told Major Streapy that he had gotten up at 9:30 or 10 a.m. and had breakfast at his father’s after checking on the cows.
The jury deliberated for about l six hours before reaching its verdicts, reducing the original charge of breaking and entering while armed with a deadly weapon to breaking and entering, which carries a minimum sentence of five years versus 20 years if armed.
