The owner of a local winery has challenged the legitimacy of recent legislation by the Rappahannock County Board of Supervisors requiring a county alcohol license for all local breweries distilleries and wineries.
A1 Kellert of Gray Ghost Winery in Amissville told the board at its -July 7 meeting that his farm should be exempt from such a tax. He said that as a farm winery he should be thought of in the same manner as any other agricultural producer.
“If you’re taxing everyone,” Kellert said, “we’ll pay the tax, but to specifically address it to the farm winery is prejudice to that form of agriculture.”
Farm wineries, he said, are required by law to produce at least 51 percent of the fruit they use on site. In addition a total of 75 percent of their fruit must be from Virginia glowers.
Furthermore, all farm wineries must be able to demonstrate that they can harvest and make their own wine.-. These regulations, he said, make his winery a form of agriculture.
