May 17, 1954 interpreted, is public educa tion a state function, a state-function fed erally dictated, or a federal function? Has the U. S. Supreme Court the right to amend the constitution and emasculate the Tenth Amendment by judicial fiat? Our position is: The U.' S. Supreme Court has usurped by judicial fiat the sov ereign rights of all of the states of the Union, not once but several times in recent decisions. A stand must be made at some point. The May 17th decision is the first of such decisions which has affected all of the people in all of the states and particu larly in the Southern States. We stand here and fight, legally, for the continuance of constitutional government under the Con stitution, or we will be forced to submit to government by all powerful oligarchies, either judicial or executive or both—the Congress having been made impotent. Virginia’s position is clear. It joins the great issue. The long legal battle is on. We, Virginians, must not weaken, equivocate, nor lose sight of the main and important issue at hand. Regardless of what other states may do, such as the compromising position taken in North Carolina, (inci dently approved for the time being by the Court), Virginia must protect with its in tegrity, love of sovereignty and liberty, the ; written Constitution of freedom, framed i principally by Virginians of great statute. In the words of the Richmond News Leader, "If devotion to the Constitution is. so dead in Virginia, and pride of race so feeble, that the people of this State will abandon both Constitution and race on the altar of a few public schoolhouses, we de serve the worst that may happen to us.”
