Drinking Drivers
Legislative recommenda tions of the Governor’s Highway Safety Committee, released today by Colonel C. W. Woodson, Jr,, the Committee Chairman and Superintendent of State Police, were directed strongly at the drinking driven The Committee is recommending that the alcohol level at which a driver is presumed to be intoxicated be lowered from the present .15 percent by weight to .10. Before reaching a level of .15, a 160-pound person must consume eight ounces of 100proof whisky within an hour. The same person will reach .10 after consuming five ounces within an hour. This measure is recommended by the Uniform Vehicle Code and is in force in North Dakota, North Carolina and Mew York.
The second recommendation is designed to prohibit failure to sign a “permission slip" or make a written request for withdrawal of blood from being considered legal grounds for refusing a chemical test. Physicians are now hesitant to withdraw blood without writ ten permission of the accused for fear of a suit for assault or invasion of privacy. As the law now stands, refusal to sign a “permission slip” ormakea request in writing for the test do not constitute refusal of the test and the 90-day license suspension for refusing with lout justifiable reasons cannot !be administered.
