A total of 728 motor vehicles vere seized by the State Police ilone during the past 12 months jnder a law (Code 46.1-351.1) jnacted by the 1964 General Assembly requiring confisca:ion by the State of a motor vehicle operated by anyone iriving under a revoked or suspended license, Colonel C. W. Woodson, Jr., Superintendent of State Police and Chairman of the Governor’s Highway Safety Committee, revealed today. This figure does not include vehicles seized by other Vi*ginia police agencies, he said As an example, Richmond city police seized 145 vehicles. This law reguires that any police office who believes he has arrested a driver operar ing under a revoked or suspended license must “seize and take possession of” the vehicle driven and turn it over to the Sheriff of the county or the Sergeant of the city in which the offense occurred. Innocent owners of cars driven by others and lien holders are protected in that they are given the opportunity to be heard. However, if innocence cannot be established, the cars are sold and the proceeds paid into the State Literary (School) fund. The driving must be without the owner’s or lienholder’s “connivance or consent" if the vehicle is to be restored. Commenting, Colonel Woodson said, “If the State cannot rule incompetent or uncooperative drivers from the road and keep them off the road, our entire driver licensing system must become useless. Confix cation is indeed a stern measure, but Virginia law permits it for such offenses as violation of our game laws or for transporting illegal whisky.”
