In that event, the judge could decide to divide the land among all seven heirs. But his clients had not chosen that route, “because they want to preserve the ordinance.” So they had tried to work within the ordinance, Lea said.

Pete Luke said that most people who spoke at the hearing before the Supervisors favored granting an exception, but not a rezoning. Since the meeting, Luke said, he has received seven phone calls in support of the Williamses. “I think an exception can be worked out,” he said.

HERBERT BARKSDALE said he didn’t want the Planning Commissioners to commit themselves to an exception without the advice of their attorney. “But it’s been our experience we can’t always count on the commonwealth’s attorney being here,” he said, obviously a bit irritated by Davis’s absence.

“Nobody denies the merits of this case,” David Fannon said. “But everybody is afraid of setting precedents.”

Pete Luke didn’t think another hearing on the Williams request was necessary. “We just need to sit down” with the attorneys and “work it out. ’ ’ The planners agreed to have a called meeting with the attorneys prior to the September meeting of the Board of Supervisors. □
