The original trial .date was Decemjber 6, at which time Judge William Carson disqualified himself from the case because of his friendship with Sam Snead’s father, Judge Raynor V. Snead. A new trial date was set for January 7 with Judge Paul from Harrisonburg presiding. Snead was represented by his brother-in-law, Attorney Eric Adamson and Coles and Green represented themselves.

Snead charged that Coles and Green picked apples of inferior quality, causing a considerable amount of apples to be returned by the packing plant. But testimony of two additional pickers called by Snead as defense witnesses failed to substantiate this charge.
