CRIGLER then argued before the Board that it was indeed proper for the Updikes to apply for the permit. “If you err in issuing a permit, that’s for the courts to decide. Your determination is what do the facts indicate.”
As to the specific site, said Crigler, “it’s the only one that’s available, and that is one test that is a legal point to be considered. Any site would generate the same objections, but you have riot been presented with any first-hand evidence that this one would be a safety or health hazard.”
