Notice is hereby given that on June 10,1977, Rappahannock County, Va. intends to request a Release of Funds and Certification for the Community of Sperryville Sewage Works Project. The Request and Certification relate to the application by Rappahannock County for Grant Funds under Title I for the construction of the Sewage Collection Lines in the Sperryville Community. It is intended to construct new sewage collector mains in all segments of the Sperryville Community. The total Porject will include all other appurtenances as necessary to constitute a complete wastewater collection and treatment system for the community.
Rappahannock County has prepared an Environmental Review Record relating to the Sperryville Sewage Works Project. The Record is currently on file in the office of the County Engineer at Washington, Virginia and therein available , for inspection. The Record may be examined by the Public and copies thereof can be obtained by the payment of reproduction costs.
The applicant for the HUD Grant Funds is Rappahannock County, Virginia. The applicant's authorized representative for this Project is Col. E. P. Luke, Chairman whose address is Washington, Virginia.
Interested parties are advised of the following facts:
Rappahannock County, Va. will undertake the project described above with Block Grant funds from the U. S. Department of Housing and Urban Development (HUD), under Title I of the Housing and Community Development Act of 1974. Rappahannock County, Va. is certifying to HUD that Rappahannock County, Va. and Col. E. P. Luke in his official capacity as Chairman of the Board of Supervisors, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action: and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, Rappahannock County may use the Block Grant funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only rf it is on one of the following bases: (a) That the certification was not in fact executed by the chief executive officer or other officer of applicant approved by HUD: or (b) that applicant's environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project m the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58): and may be addressed to HUD at the Richmond Area Office, 701 E. Franklin Street, Richmond, Virginia. Objections to the release of funds on bases other than those stated above will not be considered by HUD. No objection received after June 9,1977 will be considered by HUD.
