From now on, the Planners should insist that procedural steps be followed in the proper order, he advised. “It’s 25-acre zoning that’s doing the county in,’’ claimed Peggy Clark. She charged that an unidentified member of the Planning Commission had a large lot development with the worst access in Rappahannock and that it didn’t meet ordinance regulations. “I think it’s a good thing to practice zoning for all the people,’’ she said. “Some get zoning through and others don’t.’’ Commonwealth Attorney Davis responded that ordinance requirements applied equally to everyone and suggested that Mrs. Clark petition to have the ordinances changed if she was disatisfied with regulations.

Agricultural Character

Phil Irwin, president of The Rappahannock League for Environmental Protection, asked Davis what the Planners were required to take into consideration in action on the rezoning application.

“It’s a much different situation in rezoning that in plat approval for a subdivision,’’ answered Davis. “The Supervisors would not be acting in an arbitrary or capricious manner if they stated they wanted to maintain the-agricultural or conservation character of the county and can’t very well maintain it if they allow random scattering of subdivisions” or other incompatible uses, Davis said, ty Land best suited for farming is also land best suited for development, noted Davis. “I don’t think you’d have any trouble with the Supreme Court upholding the county’s decision that it (the preservation of agricultural character) is In the best Interests of the people in the county and a proper exercise of police powers in denying a subdivision in an agricultural district,” stated Davis. He added that the Supervisors would need to set forth ,feaaons that show the denial is based on the original intent | of the county’s ordinances.
