Slopes Studied Davis disagreed. “More scientific research was done in this county on slopes, soils and land usage than any other county in the state of Virginia. . .An excellent engineering study was made” and all this was taken into consideration and incorporated in Rappahannock ordinances, he said. “Our ordinances have been tested in court and in every instance, they stood up. I think they will stand up in every future instance,” Davis stated. Luke suggested that the Planning Commission hold a public hearing to get citizen opinion on whether the rezoning for Good’s property should be recommended to the Supervisors.

Davis agreed that this was the proper course to follow. He added that developers should first submit a rezoning application before applying for preliminary plat approval on a subdivision.

“It’s disappointing to me, sir, that this governing body has been functioning so long without knowing what to do,” interjected real estate agent Peggy Clark.

All apeaking at the same time, several Planners immediately defended the Commission, stating that confusion only involved the. proper order of procedural steps.

The Planners voted unanimously to hold a public hearing on the rezoning.

“We’ve been up here four times. Why is this the first time that rezoning is mentioned?” asked a developer representative.

“We thoujght pan knew what you were doing,” Chairman Barksdale responded, adding that the requirement was clearly stated in the ordinance.

“Why wasn’t it told us three months ago? countered the developer spokesman.

Newbill Miller answered that rezoning had been ; mentioned at previous meetings; whether the developer remembered it or not. f ;
