Copeland added that constitutional conflicts may require the law to be modified, noting that it was the legislation’s intent to make a district eligible for land use taxation.

Jacks again stressed that the constitution requires all land within the same classification to be taxed uniformly. But he added that the definition of classification hadn’t been decided. There are two state ordinances that apply to land use tax, with implementation of both subject to the same constitutional provisions, according to Jacks.

“There’s no clear answer on whether we’re doing that,” he stated. “It’s like walking through a minefield,” commented Jacks.
