Miller said he was basically in agreement with Davis’s suggestions. According to Davis’s report on recent court decisions, Miller noted that there was a sounder basis in law for approval or denial of development if the Board of Supervisors was involved.
“The only thing I can see as a problem is holding two public hearings (before the Supervisors for rezoning and BZA for conditional premit) rather than the one now held by the Board of Zoning Appeals (for issuance of a special use permit),” said Miller.
“The only way to preserve agriculture and forestry land is to have each special use reviewed by the Board of Supervisors,” Davis maintained. “It will tighten out ordinances.
