Carter continued that failure to include forestal land in a land use taxation ordinance in no way inhibited the county from adopting an agricultural and forestal district and giving use value taxation to forest land ONLY within the approved district.
William Spieden noted that it would be difficult for open space to qualify for inclusion in an AF District since all property within the district must have a five year history of agricultural or forestry use. He described open space holdings as "usually speculative” and added that he believed most of the AF District applicants would agree open space shouldn’t be included.
Supervisor Chairman Lindsay Gordon asked for a motion on the three original applications and two others added at last Thursday'* hearing. His request met with silence until finally Colvin moved for denial, immediately seconded by Supervisor R. Monroe Waugh.
Edwards stated that he would vote against approval. “It grieves me that I have to...The law is just not ready for implementation at this point.” He maintained that the Attorney General's opinion was very vague and raised additional questions of constitutionality.
